General Terms and Conditions for E-commerce Retail

BEST OF BEST – DIAMOND AND GEM

1. Introduction

(a) The Seller operates an online store offering jewelry and accessories under the brand BEST OF BEST – DIAMOND AND GEM. These general terms apply to all purchases unless otherwise agreed upon by the parties.

(b) These terms apply to private individuals purchasing exclusively for personal and non-commercial purposes. A business buyer is defined as any natural or legal person, or legal entity acquiring products for commercial or professional use.

(c) Any deviation, supplement, or conflict with these terms shall be deemed invalid unless expressly agreed to in writing between Buyer and Seller.

(d) We reserve the right to modify these terms at any time. New terms supersede prior ones.

(e) By using this website (including accessing, browsing, or registering), you unconditionally accept these Terms and agree to comply with them.

2. Contract Formation

(a) The Seller may modify its offer at any time without notice. While we strive to present accurate colors, styles, and designs on our website, differences may occur due to device display limitations. BEST OF BEST – DIAMOND AND GEM shall not be liable for inaccuracies or color deviations in product images. For questions, contact: office@rfidsmartsolution.hu.

(b) Order confirmation implies full acceptance of these Terms. All orders are placed online via our website and constitute a legally binding purchase contract. Clicking “Place Order” confirms the binding purchase. Orders cannot be modified or cancelled unless specified otherwise in these Terms.

(c) Buyers receive an order acknowledgment via email. This does not constitute contract acceptance. The contract becomes valid upon receipt of a shipping confirmation or order acceptance.

(d) Preparing products for dispatch is also considered acceptance. The Seller reserves the right to decline any order without justification.

(e) The contract is conditional on successful delivery by the supplier. If a product becomes unavailable through no fault of the Seller, a full refund will be issued promptly. Partial availability will also be communicated immediately.

(f) Upon conclusion of the contract (especially for online orders), the legally binding contract text will be emailed to the Buyer. All order data serves as proof of the transaction. In the case of disputes, the recorded order data will be considered conclusive evidence.

3. Retention of Title and Withdrawal

(a) For consumers: Ownership of products remains with the Seller until full payment is received.
For business buyers: The Seller retains ownership until all outstanding claims are settled.

(b) In case of breach of contract (non-payment, insolvency, or false information), the Seller may cancel the contract and demand product return.

(c) Business customers may resell goods in the course of business, but all resulting claims are transferred to the Seller. The Seller may collect payment directly if the business fails to comply with obligations.

(d) If the recoverable value of the goods exceeds our claims by more than 10%, the Seller will release securities at its discretion.

4. Prices and Payment

(a) Prices may change and are based on current price lists plus applicable VAT.

(b) For long-term contracts, additional shipping costs apply as outlined under section 6. VAT is added and paid by the Buyer.

(c) Offsetting claims is only allowed for undisputed or recognized counterclaims.

(d) BEST OF BEST – DIAMOND AND GEM reserves the right to cancel orders due to typographical or pricing errors without further obligations.

5. Payment Methods and Shipping Costs

(a) Accepted payment methods include major credit cards (Visa, Mastercard, American Express), PayPal, and bank transfer. The Seller may refuse certain payment methods.

(b) Payments via card or PayPal are charged in Hungarian Forint (HUF).

(c) PayPal users must have a registered PayPal account. Orders ship only after payment is fully received.

(d) Shipping charges are defined under the Shipping Costs section.

6. Shipping

(a) Prices include VAT (if applicable) but exclude shipping fees unless otherwise stated. Free shipping is offered; however, import duties may apply. Returns that violate our policy may incur a 6000 HUF fee.

(b) If a product is out of stock, the Buyer will be notified of the delay and estimated shipping time.

(c) The Seller may split deliveries into multiple shipments with no additional cost to the Buyer.

7. Risk Transfer

(a) Consumers must verify the goods upon delivery. Any discrepancies (damaged, missing, or incorrect items) must be documented with the courier. Risk of loss or damage transfers upon receipt.

(b) For business buyers, risk transfers upon handover to the logistics provider. Refusing delivery is considered acceptance.

(c) Import duties and customs fees are the responsibility of the Buyer.

8. Right of Withdrawal

(a) The Buyer has the right to withdraw within 30 days of delivery by submitting a Return Form and complying with our return policy. Custom or personalized items are excluded.

(b) The withdrawal period begins upon receiving written notice from the Buyer and proper information from the Seller.

Consequences:

  • Full return of goods and funds, including benefits (e.g., interest).

  • Damaged or missing items may reduce refund value.

  • Return shipping is at the Buyer's cost.

  • Refunds processed within 30 days of return or notice.

(c) Non-returnable items:
Custom-designed or engraved products; items with certified diamonds (IGI/GIA).

9. Returns

(a) For private individuals not buying for business use, the right of return is subject to section 8. Items must be returned in original condition and packaging.

(b) Items that are engraved or custom-made are not eligible. IGI/GIA certified items cannot be returned.

10. Warranty

(a) Slight deviations from product photos may occur. Buyers must verify product details before confirming the order.

(b) Seller may offer repair or replacement. Alternative remedies apply if the first is unreasonable.

(c) If repair or replacement fails, the Buyer may request a refund or cancel the order, except in the case of minor defects.

(d) Warranty claims require proper notification, especially for businesses within 14 days of receipt.

(e) For business clients, only the manufacturer’s commercial descriptions are contractually binding.

(f) Warranty is valid for 2 years unless misuse or negligence occurs.

(g) No other legal guarantees apply unless agreed separately.

11. Limited Liability

The Seller is liable only for foreseeable, contract-typical damages. This includes acts of minor negligence by legal representatives or agents.

12. Privacy Policy

Please review our Privacy Policy before using our site. By using the website, you consent to data collection and use as described.

Data is processed in compliance with GDPR (EU Regulation 2016/679), the EU-U.S. Privacy Shield, and local regulations.

We collect: contact info, IP address, order details, support communication, and—if needed—ID verification data, images or videos (for promotions).

We do not store credit card or payment instrument details.

Data is processed to:

  • Fulfill and ship orders

  • Communicate order status

  • Validate warranties

  • Comply with tax laws

  • Prevent fraud or identity theft

Data is stored:

  • As long as registration is active

  • Up to 2 years after delivery for warranty/return purposes

  • For legal record-keeping

Your rights include:

  • Access and request a copy of your data

  • Request correction or deletion

  • Withdraw consent (where applicable)

13. Amendments to Terms

(a) We reserve the right to amend these Terms with 2 weeks' prior notice via publication on our website.

(b) If no objection is raised within that period, changes are deemed accepted.

14. Final Provisions

(a) These Terms are governed by the laws of the Federal Republic of Germany, excluding CISG provisions. Consumer protections of your home country still apply if mandatory.

(b) In case of disputes with business clients, the exclusive jurisdiction lies with the courts at the Seller’s registered office, unless otherwise agreed.
